eBAY and RE/MAX Settle Suit

earlier this month. In that lawsuit, RE/MAX International alleged that eBay"s use of a red, white and blue real estate sign in a television commercial infringed RE/MAX trademarks. eBay agreed to cease utilizing the television commercial effective January 17 and agreed to modify the real estate sign in the future so it will not look like or be confused with a RE/MAX sign. eBay also has agreed not to use the RE/MAX trademarks or any similar marks or designations in connection with their future advertising. "It is important that everyone understands that once eBay and their counsel were made aware of the established and federally protected trademark rights of RE/MAX, they were most cooperative in attempting to correct the situation," said Daryl Jesperson, RE/MAX president. "It is unfortunate that these types of issues arise, but it further reinforces our belief that we must continue to be diligent in protecting the valuable RE/MAX trademarks."
